ANVISA's authority to regulate labeling of gluten-containing foods confirmed

The Attorney General's Office (AGU in Portuguese) guaranteed the application of the legislation that makes mandatory the inscriptions “contains gluten” or “does not contain gluten” on the labels of processed foods marketed in the country and confirmed the regulatory competence of the National Health Surveillance Agency (ANVISA) on this type of labeling.
This decision reinforces the technical and regulatory role of the National Health Surveillance Agency (ANVISA in Portuguese) and contributes to the legal security of the food sector. It avoids, for example, that products of the same nature have different information on their labels, not because of their characteristics, but because of isolated judicial decisions. With this decision, ANVISA hopes to persuade the STJ to reevaluate its jurisprudence, emphasized the lawyer.
