ANMAT announces modification of the regulation on front food labeling

The National Administration of Drugs, Food and Medical Technology (ANMAT in Spanish) has published 2 new Provisions 11378/2024 and 11362/2024, which amend the Application Manual of Law No. 27642 and Decree 151/22 on the front labeling system, indicating the presence of critical nutrients in excess, such as “Excess sugars”, “Excess sodium”, “Excess saturated fat”, “Excess total fat” and “Excess calories”.

Relevant aspects of the new provisions:

The previous resolution detailing how warning labels must be presented on products is eliminated. Now, labels must inform only the ingredients added to the product, differentiating between natural nutrients (such as sugars present in fruits) and those that have been added during its manufacture (sugars, sodium, fats, etc.).

In addition to the changes in labeling, the new provision also introduces stricter regulations on the advertising of packaged foods and beverages. As indicated in the previous regulation, the prohibition of advertising these products to children and adolescents is maintained. The law prohibits any type of promotion, sponsorship or advertising of food with at least one warning label aimed especially at this age group.

Products already labeled according to the previous regulations will continue to be marketed until stocks are exhausted. Thereafter, companies must comply with the new provisions set forth in provision 11362/2024.
