New proposal against “shrinkflation”

Spain

Nov 18, 2024

The Congress of Deputies has introduced a new draft law to combat the practice of "shrinkflation." Under the proposal, an amendment will be made to the General Law for the Defense of Consumers and Users and Other Complementary Laws, as established by Royal Legislative Decree 1/2007, dated November 16.

The amendment mandates that when a pre-packaged product is sold with a constant nominal quantity, consumers must be clearly and understandably informed if this quantity is reduced, leading to an increase in the price per unit of measure, while the packaging design remains the same or similar. To fulfill this information requirement, the reduction in quantity and the resulting price increase must be prominently and legibly displayed at the point of sale for at least 90 days from the first marketing of the product with the new characteristics.
