New requirements for chocolate and chocolate products

On July 25, 2023, the amendments to the Customs Union technical regulation "On food safety" (TR TS 021/2011), which establish uniform requirements for chocolate and chocolate products, came into force.

According to the regulation, chocolate includes bitter (or dark), dark, ordinary, sweet, milk, extra milk, white chocolate, chocolate with filling and chocolate powder. Chocolate products include confectionery products containing 25% or more separable chocolate component of the total mass of the product.

Under the new mandatory requirements, chocolate put into circulation in EAEU countries must contain 35% or more of total cocoa solids, including 18% or more cocoa butter. The filled chocolate must contain 25% or more of the outer part of the chocolate separable from the filling. At the same time, filled chocolate does not include bakery products (including rich bakery products), flour confectionery products and chocolate-covered ice cream.
