EU - Food Law: between technical standards and legal rules. About the CJEU judgment on «vegetable burgers»

The CJEU has delivered a judgment on the labelling of food that highlights the difficulties arising from an overly detailed regulatory framework. The present paper delves into the shortcomings of the current regulatory framework in food labelling and analyses whether alternatives to the interpretation proposed by the CJEU can be found within the legal system, as well as forms of regulation that avoid the problems generated. It examines, in particular, the need to separate legal standards from techniques, the desirability of a more flexible regulatory model and the recovery of the integrative role of general principles of law. This issue is part of the increasingly urgent trend towards regulatory simplification in Europe.
