FDA proposes new amendments to food additive regulation

The Food and Drug Administration (FDA) has published Draft Ministry of Public Health (MOPH) Notification, No. … B.E. …. (....) issued by virtue of the Food Act B.E. 2522 entitled "Prescribing the principle, conditions, methods and proportion of food additives (No .4)".

The Ministry of Public Health (MOPH) considered that it was  appropriate to revise the detail of maximum permitted food additives that have been  authorized, as follows:

  • Clause 1 - The Annex I and Annex II of the notification of the Ministry of Public Health  (No. 444) B.E. 2566 issued by virtue of the Food Act B.E. 2522 Re: Prescribing the  principle, conditions, methods and proportion of food additives (No. 3), dated  14 November B.E. 2566 (2023), shall be repealed and replaced with the Annex I and  Annex II of this notification.
  • Clause 2 – Manufacturers or importers of foods for sale, which food additive contained in  such food has been approved prior to this notification comes into force and the provisions  of food additive comply with the notification of the Ministry of Public Health (No. 444)  B.E. 2566 issued by virtue of the Food Act B.E. 2522 Re: Prescribing the principle,  conditions, methods and proportion of food additives (No. 3), can continue to sell the  existing products, but not exceed two years from the enforcement date of this notification.
  • Clause 3 - This notification shall come into force from the day following the date of its publication in the Government Gazette.
