Spain

Dec 20, 2024

The Ministry of Social Rights, Consumption and Agenda 2030 has published the draft Royal Decree amending Royal Decree 1086/2020, of December 9, which regulates and relaxes certain conditions for the application of European Union provisions on hygiene in the production and marketing of foodstuffs and regulates activities excluded from its scope of application and Royal Decree 1021/2022, of December 13, which regulates certain requirements regarding hygiene in the production and commercialization of foodstuffs in retail establishments.

The draft Decree, which comes from the Spanish Agency for Food Safety and Nutrition (AESAN in Spanish), aims to adapt Royal Decree 1086/2020, of December 9, to the needs of the food sector and the competent authorities of the autonomous communities, extending the flexibility measures in the application of the hygiene regulations in some sectors and maintaining consistency with European regulations, as well as modifying Royal Decree 1021/2022, of December 13, to include additional flexibility measures not contemplated and to improve the comprehensibility of the text.

Interested parties may submit their comments until January 17, 2025.
