The First Section of the Superior Court of Justice (TSJ in Portuguese) decided to authorize the importation of seeds and the cultivation of cannabis exclusively for medicinal, pharmaceutical and industrial purposes. The decision applies to the so-called industrial hemp (hemp), a variety of cannabis with a percentage lower than 0.3% of tetrahydrocannabinol (THC), the psychoactive ingredient of marijuana.
During the session, the members of the TSJ understood that the concentration is not considered narcotic. Therefore, cultivation cannot be restricted due to the low THC content. With the decision, the National Health Surveillance Agency (ANVISA in Portuguese) will have six months to regulate the issue.
