Ministry of Health proposes new regulation to increase controls on functional foods and food supplements

The Ministry of Health is seeking comments on a draft decree amending and replacing Decree 15 on food safety management, with a series of new regulations aimed at filling gaps in the management of functional foods and dietary supplements. For health protection foods, medical nutritional foods, and foods for infants under 36 months of age, the draft requires monitoring of ingredients, safety indicators, quality, and uses from the research and development stage through registration and market launch. Previously, companies only needed to commit to compliance and assume full responsibility, leading to a situation where some units intentionally mixed ingredients that had no real effect, only to advertise this "explosively" on the label.
For the registration process of health protection food products, the Ministry of Health has established new regulations requiring companies to clearly and comprehensively report the product development process, transparently, from ingredients and uses to related scientific evidence.
First, companies must communicate the rationale for choosing their product formula. This means explaining why these ingredients are combined to achieve the primary function, as well as any additional ingredients that may be added.
At the same time, research must also be conducted on interactions between ingredients, between ingredients and additives, and direct-contact packaging (Level 1 packaging) and clearly communicate these interactions.
