New draft of the Caffeine Safety Law

Representative Robert Menendez introduced a Caffeine Safety Bill (H.R.2511) before the House of Representatives. The bill would require chain restaurant menu items containing at least 150 mg of caffeine to include a statement such as “high caffeine content.” In addition, the bill amends Section 403 of the Food, Drug, and Cosmetic Act to deem foods and dietary supplements containing more than 10 mg of caffeine as misbranded unless the label includes the amount of caffeine in the product, a statement indicating whether the caffeine is natural or an additive, and an informational statement about the FDA recommended daily limit of caffeine for healthy adults.
The bill also directs FDA to define “added caffeine” and revise the classification of caffeine and other stimulants as generally recognized as safe (GRAS).
