ITALY – LARGE FINES FOR UNAUTHORIZED CLAIMS IN SUPPLEMENT ADVERTISING

The Italian competition and fair market practices authority (Autorita Garante della Concorrenza e del Mercato (AGCM)) imposed several fines for the repeated display of a deceitful advertisement for a food supplement named Orac Spice.

It the concerned tv spot, preventive and therapeutic claims were made for the product’s ingredients that are not substantiated by science and which exceed what would be permissible for food supplements in general in terms of physiological effects. The producer was fined 250,000 euro, while the broadcaster was fined with 40,000 euro for repeatedly showing the advertisement.
