Changes required in the sampling of dried herbs, herbal infusions, teas and powdered spices for mycotoxins

Following recent research by the German Federal Institute for Risk Assessment (BfR), an amendment has been made to Implementing Regulation (EU) 2023/2782, which regulates the sampling and analysis methods for mycotoxins in dried herbs, herbal infusions, teas, and powdered spices. This amendment will ensure that samples taken represent the sampled batch more effectively. The changes made include an increase in the required sample weight and more precision of the rules for sampling food supplements that contain dried herbs. The following points were adapted in the Annex of the regulation:

  • M.1. Weight of the incremental sample.
  • M.2. Division of lots into sublots for the sampling of dried herbs, herbal infusions (dried product), teas (dried product) and powdered spices.
  • M.3. Method of sampling for dried herbs, herbal infusions (dried product), teas (dried product) and powdered spices (lots ≥ 15 tonnes).
  • M.4. Method of sampling for dried herbs, herbal infusions (dried product) and teas (dried product) and powdered spices (lots < 15 tonnes).
  • M.5.Sampling at retail stage.
  • M.6.Sampling of food supplements containing dried herbs in bulk before their packaging in retail/individual packages for the final consumer.
  • M.7.Acceptance of a lot or sublot.
