AMS Publishes Final Rule for Updates to the List of Bioengineered

The U.S. Department of Agriculture (USDA) Agricultural Marketing Service (AMS) published a final rule to update the National Bioengineered Food Disclosure Standard’s List of Bioengineered Foods. One new product will be added to the list, and one product already on the list will be amended to better reflect only BE varieties.
A final rule [https://www.federalregister.gov/d/2023-26059] establishing the list updates was published in the Federal Register on November 29, 2023. This final rule becomes effective on December 29, 2023. Mandatory compliance will begin on June 23, 2025.
AMS is revising the list to:
- Add “sugarcane (Bt insect-resistant varieties).”
- Amend “squash (summer)” to “squash (summer, coat protein mediated virus-resistant varieties).”
The final rule was developed based on public comments received from the proposed rule [https://www.federalregister.gov/d/2022-15728] published in the Federal Register on July 22, 2022. The comment period for the proposed rule closed on Sept. 20, 2022, with a total of 37 comments.
